Data Protection Statement for the recruitment process at Teufel

General provisions
We make this Data Protection Statement available in accordance with Article 13 GDPR. It serves
the purpose of informing you about how we handle your personal data collected during the
recruitment process.

Collection and processing of personal data during the recruitment process
Personal data means information about personal or other circumstances of a certain or identifiable
individual person. This includes information that can, with reasonable effort, be traced back to a
certain person, e.g. your name, your address, your telephone number and your date of birth, as
well as data about your previous career etc. Data that are not directly or indirectly associated with
your real identity are however not considered personal data.

Legal bases and purposes of processing personal data during the recruitment process
If you submit your application to us electronically, by email or via our web form, we will collect
your personal data for the purpose of conducting the application process and to perform certain
pre-contractual actions on our part.
When you use our recruiting page to submit an application to us or when you send your documents using other communication channels, you express your interest in being
offered employment by our company. This entails the disclosure of certain personal data that we
will process exclusively for purposes related to your job application.

The data collected includes, but is not limited to:
Name (first and last name)
Email address
Telephone number


You are also given the opportunity to upload relevant documents or send them to us via other communication channels such as a cover letter, resumé,
letters of reference or education certificates These documents may contain further personal data,
such as your date of birth, address etc., as well as information about your educational background
and professional development.


If you apply via a social media platform (e.g. LinkedIn) we process the following data:

Information about the data collection of the providers of social media platforms may be obtained directly from the providers.

In order to organize our appointments in the recruitment process we are using a software called MS Bookings of Microsoft Ireland Operations Ltd. (South County Business Park Dublin D18 DH6K). For that purpose we’ll send you a link to the bookings-page.

The data collected through the process includes, but is not limited to:

E-Mail-Address

It is up to you whether you also enter the telephone number or a note to us. By sending the data via the "Book" button, your proposed appointment and your data will be transferred to Microsoft and us.

Access to your data is strictly limited to authorised employees from our human resources
department and staff members involved in the application process.
Your personal data is stored exclusively for filling the vacant position you have applied for with a
suitable candidate. The legal basis for collecting your data is Article 88 (1) GDPR i.c.w. Section 26
(1) Federal Data Protection Act.

We will store your data for a period of 180 days from completion of your job application. In most
cases, this serves the purpose of satisfying our legal obligations, or defending ourselves against
claims arising from statutory provisions. Once we are no longer under such an obligation, the law
requires us to delete or anonymise your data. If the data is anonymised, it will only be available to
us for statistical analysis in the form of so-called meta data without any direct references to
persons (e.g. quota of applications from males/females, applications received in a certain period
etc.).
If the application process results in our company offering you a job and you accept our offer, we
will store the data collected during the application process for at least the duration of your
employment with us. The data of MS Bookings will be deleted monthly.
 
 

Disclosure of the data to third parties
The data you disclose to us during the application process will be TLS-encrypted before being
transmitted and stored in a database. This database is operated by Personio GmbH, Rundfunkplatz
4, 80335 Munich, Germany. Personio GmbH is the provider of a human resources and candidate
management software( https://www.personio.de/impressum/. Personio acts as our contract data
processor pursuant to Article 28 GDPR. The legal basis for the data processing is in this instance an
agreement on the processing of data under a contract between us as the data controller and
Personio GmbH.


The data processed via MS Bookings is transferred to Microsoft Ireland Operations Ltd. (South County Business Park Dublin D18 DH6K).


Revoking consent
In as far as the processing of personal data is based on your previously granted declaration of
consent, you have the right to revoke consent at any time pursuant to Article 7 (3) GDPR. A
revocation of consent is without prejudice to the lawfulness of data processing prior to revocation
of consent.

Rights of data subjects
The General Data Protection Regulation gives you as a data subject the following rights:
a) Where your personal data is being processed, you have the right to being provided with
information about the stored data that relates to you personally. (Article 15 GDPR)
b) Where the processed personal data is inaccurate, you have the right to request the correction
of such data (Article 16 GDPR)
c) if you satisfy certain legal criteria, you may request your data to be deleted, the processing of
your data to be restricted and object against the processing of your personal data (Articles 17,
18, 21 GDPR)
d) If you have granted your consent to the processing of data, or if there is an agreement on the
processing of personal data under a contract and the data is processed with the help of
automated methods, you may also be entitled to the right to data portability. (Article 20
GDPR).

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. Rights of data subjects

KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced.
